We are pleased about your interest in our vacation apartment. Data protection has a very high priority for us. Personal data (hereinafter generally referred to as "data") are processed by us only to the extent necessary and for providing a functional and user-friendly website, including its contents and the services offered.

Per Art. 4 para. 1 of EU regulation 2016/679, i.e. the General Data Protection Regulation (hereinafter referred to as "GDPR"), "processing" refers to any operation or set of operations such as collection, recording, organization, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment, or combination, restriction, erasure, or destruction performed on personal data, whether by automated means or not.

II. Rights of users and data subjects

Regarding the data processing to be described in more detail below, users and data subjects have the right:

  • to confirmation of whether data concerning them is being processed, information about the data being processed, further information about the nature of the data processing, and copies of the data (see also Art. 15 GDPR);

  • to correct or complete incorrect or incomplete data (see also Art. 16 GDPR);

  • to the immediate deletion of data concerning them (see also Art. 17 DSGVO), or, alternatively, if further processing is necessary as stipulated in Art. 17 para. 3 GDPR, to restrict said processing per Art. 18 GDPR;

  • to receive copies of the data concerning them and/or provided by them and to have the same transmitted to other providers/controllers (see also Art. 20 GDPR);

  • to file complaints with the supervisory authority if they believe that data concerning them is being processed by the controller in breach of data protection provisions (see also Art. 77 GDPR).

 

In addition, the controller is obliged to inform all recipients to whom it discloses data of any such corrections, deletions, or restrictions placed on processing the same per Art. 16, 17 para. 1, 18 GDPR. However, this obligation does not apply if such notification is impossible or involves disproportionate effort. Nevertheless, users have a right to information about these recipients.

Likewise, under Art. 21 GDPR, users and data subjects have the right to object to the controller's future processing of their data pursuant to Art. 6 para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permissible.

III. Information about data processing

Your data will be deleted or blocked as soon as the purpose of the storage no longer exists, the deletion of the data does not conflict with any statutory storage requirements and no other information is provided on individual processing methods, below.

a) Data collected when visiting our website

The use of our website is generally possible without you providing us personal data. However, if you wish to use special services on our website, personal data may be required.

We have implemented numerous technical and organizational measures to ensure the most complete protection of personal data processed via this website. Nevertheless, Internet-based data transmissions can generally have security issues, so that absolute protection cannot be guaranteed. YouTube

Our website uses plugins from YouTube. Site operator is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

It tells the YouTube server which of our pages you've visited.  Furthermore, YouTube can store various cookies on your device. With the help of these cookies, YouTube can receive information about visitors to our website. This information is used to capture video statistics, improve usability and prevent fraud. The cookies remain on your device until you delete them.

If you are logged in to your YouTube account, YouTube will allow you to associate your browsing behaviour directly with your personal profile. You can prevent this by logging out of your YouTube account.

Google Web Fonts

This site uses so-called web fonts provided by Google for the uniform representation of fonts. As a result, Google learns that our website has been accessed via your IP address.  If your browser does not support web fonts, a default font will be used by your computer.

Inquiries by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your request, including all resulting personal data (name, request) will be stored by us to process your request. We will not share this information without your consent.

If your inquiry is related to the performance of a contract or is required for pre-contractual processes, processing of this data is based on Art. 6 para. 1 lit. b) GDPR. In all other cases, the processing is based on your consent (Art. 6 para. 1 lit. a) GDPR) and/or for our legitimate interests in the effective processing of requests addressed to us (Art. 6 para. 1 lit. f) GDPR).

The data sent by you to us via contact requests remain with us until you ask us to delete them, revoke your consent to the storage or the purpose for the data storage no longer exists (e.g. after completion of your request). Mandatory statutory provisions - in particular statutory retention periods - remain unaffected.

b) Data collected when booking our vacation apartment

Data provided by you when booking our apartment will be processed by us for the sake of contract execution and are required in this respect. Conclusion of contract is not possible without you providing us this data.

The legal basis for processing is Art. 6 para. 1 lit. b) GDPR.

​

We delete the data with when the contract has been completely processed, but we must observe tax and commercial retention periods.

​

According to the statute of the City of Herrsching am Ammersee from Oct. 16, 1985 and approved by the government of Upper Bavaria on Nov. 29, 1985 (Ref. 231.1405 STA) and the amending statute of March 9, 1988, approved by the government of Upper Bavaria on Apr. 12, 1988 (Ref. 2303.1405 STA) we are obliged to transfer the following information to the City of Herrsching am Ammersee to determine spa taxes:

  • Name

  • Address

  • Duration of stay (from-to)

  • Number of guests (adults and children)

  • Purpose of stay (private or business)

The legal basis for the transfer of the data is Art. 6 para. 1 lit. b) GDPR.
